This indenture made the fourteenth day of March in the sixth year of the reign of his Majesty King George the Second and in the year of our Lord one thousand seven hundred and thirty two BETWEEN John Thornton of preston in the county of Lancaster Esquire of the one part and Sarah Gibson of Lancaster in the County aforesaid widow of the other part WITNESSETH that the said John Thornton for and in consideration of five shillings of lawfull mony of Great Britain ..... Sarah Gibson at or before the sealing and ..... presents the receipt whereof is hereby acknowledged HATH bargained and sold and by these presents doth bargain and sell unto the said Sarah Gibson her Executors Administrators and Assigns ALL that Capitall Messuage and tenement with the appurtenances situate lying and being in Thornton in the said County commonly called and known by the name of Thornton hall and all those severall closes closures and parcells of land meadow and pasture ground lying and being in Thornton aforesaid and usually ocupyed and enjoyed with and accepted reputed had? taken and known to appertain and belong to the said Capitall Messuage and tenement and hereinafter perticularly incutioned? that is to say the Great field, the Hode fast, the great Tennacar Rand, the little Tennacar Rand, the Banckhey, the Cowhey, and Oxhey, containing in the whole by common estimation thirty two Acres of land meadow or pasture or thereabouts be the same more or less or by what other name or names soever the said Messuage Tenement Closes Closures and parcells of Land meadow and pasture and every or any part of them now are or heretofore have been called or known with their and every of their appurtenances together with free fishings and other liberties and previledges autiently? belonging to the said Capitall Messuage in the River of Wire which sad Capitall Messuage Closes parcells of Land and premisses were formerly purchased by Richard Fleetwood Esquire from John Hebson and Margaret his wife and were lately in the possession of Henry Hoggard and Thomas Hebson deceased or the one of them their or one of their assignee or assigues and are now in the possession of Richard Smithson or his assigues AND all that one other Capitall Messuage and dwelling house situate lying and being in Wessham in the said County commonly called and known by the name of Wessham house alias Wessham hall with the Barns Stables Outhouses Orchards Gardens and Folds thereunto belonging and all those several Closes Closures and parcells of ground lying and being in Wessham aforesaid and usually occupyed and enjoyed with and accepted reputed had taken and known to appertain and belong to the last mentioned Capitall Messuage and herein hereafter particularly mentioned that is to say the Old Earth, the Green, the Hill Meadow, the Croft on the back of the House, the Brigg Flatt, the Bottom Meadow, the Carr Meadow, the three Town Hills, the Anchor Hill, the nearer Moss shoot, the further Moss Shoot, the Moss Shoot Bottom, the Arbary, the Cross Flatt, the Asprells? Meadow, Hills Hey, and Greenalls fields containing in the whole by common estimation forty five acres of Land Meadow or pasture or thereabouts be the same more or less or by what other name or names soever the said last mentioned Messuage Closes Closures and parcells of Land Meadow or pasture and every or any part of them now are or heretofore have been called and known together with all Fishings Royalties Liberties previledges and appertenances thereunto belonging all of them now or late in the tenure possession or occupation of John Sawrtbreck? or his assigues AND all those three several Cottages or Cottage Houses in Wesham aforesaid antiently belonging to the said Capitall Messuage called Wesham house als Wesham hall with the Gardens Closes and parcells of Land and other appurtenances usually occupyed to and with the said Cottages containing in the whole by common estimation three acres of Land or thereabouts be the same more or less commonly called by the several names following that is to say Lawsons Cottage with the appurtenances with one Garden two acres of ground or thereabouts thereto usually belonging formerly in the possession of Robert Lawson or his assigues and now or late in the possession of **** (Daniel?) Lawson or his assigues and all that other cottage with the appurtenances called Southworths Cottage with one Garden and one Croft containing about half an acre of ground thereto usually belonging now or late in the possession of the said John Swartbreck? or his assigues and one other cottage with the appurtenances formerly in the possession of Elizabeth Greenall widdow or her assigues and now in the possession of the said John Swartbreck? or his assigues with one Garden and one Croft called Greenalls Croft containing in all about halfe and acre of ground thereto usually belonging all which said last mentioned Messuage Cottages Closes Closures and parcells of Land in Wessham were formerly purchased by the said Richard Fleetwood of and from John Fleetwood and Charles Fleetwood AND also all that part portion and share of a certain Close or parcell of Land in Thornton aforesaid called the Oxhey as the same is allready ******* (ineared?) set out and now inclosed containeing in length sixty three yards and in breadth at the North End thereof fifty seven yards and at the South End thereof sixty eight yards and also the Edifice or Building erected and now standing and being thereupon or upon some part thereof commonly called the Warehouse in Thornton or commonly used as such and likewise all such and so much of the Wharfe and Wast Grounds belonging to the said premises as lyes on the East End thereof and directly opposite thereunto but no more further or otherwise and likewise all ways other then such as lead into through and over any of the inclosed lands formerly belonging to and in the possession of the said John Hebson and Margarett his wife or the one of them which said part of the Oxhey, was formerly the Inheritance of Robert Sturzaker and now is or lately was in the possession of the said John Thornton or his assigues together with all and singular houses outhouses Edifices Structures Buildings Barns Stables Shippons Orchards Gardens Courts Foulds Backsides Crofts Lands Tenements Meadows Feedings pastures woods underwoods ways waters watercourses paths passages Hedges Ditches Fences Mines Quarries Dells? Fishings Commons Common of pasture and Turbary Moores Mosses Moss Grounds Marshes Rights Royalties Members perquisites Emoluments Easements Liberties profits previledges Commodities advantages and appurtenances whatsoever to the said **** by granted premisses or any part thereof belonging or in any wise appertaining or to or with the same or any part thereof now or at any time theretofore had used occupyed possessed or enjoyed or accepted reputed had taken or known as part Parcell or Member thereof or of any part or Parcell thereof and the Reversion and Reversions Remainder and Remainders thereof and all Rents Boons? Duties and Services whatsoever reserved upon any Demise Lease Estate or Grant Demises Leases Estates or Grants heretofore made or granted of the said premises or any part or parcell thereof To Have and to Hold the said Messuages Cottages Closes Closures parcells of Land hereditaments and premises and every part and parcell thereof with their and every of their appurtenances unto the said Sarah Gibson her Executors Administrators and Assigues from the next before the day of the date of these presents for and dureing the Term of one whole year from thence next ensuing and fully to be compleat and ended ***** and paying therefore unto the said John Thornton his heirs and assigues the Rent of one peppercorn the last day of the term if the same shall be lawfully demanded TO THE INTENT and purpose that by virtue of these presents and of the statute for transferring uses into possession the said Sarah Gibson may be in the actuall possession of the said hereby bargained premises with the appurtenances and be thereby enabled to accept and take a Grant and Release of the Reversion and Inheritance thereof to her the said Sarah Gibson her heirs and assigues in such manner as the said John Thornton doth intend to grant and Release the same by indenture intended to bear date the day next after the day of the date of these presents IN WITNESSE whereof the said parties to these presents have hereunto interchangeably put their hands and seals *** the? day and year first above written
